Smile Virtual Consult, LLC (“SVC” or “We”) respects your privacy and is committed to protecting it through our compliance with this policy.

It also describes the information that we may collect from you when SVC provides you with online services, including its web-based solution that connects potential patients interested in learning more about how to improve their smile with potential healthcare providers, as well as any mobile and desktop applications you download from the Website, the Apple App Store, and Google Play store, which provides dedicated non-browser-based interactions between you and SVC (collectively, our “Services“). Access rights to the Services may be obtained from SVC either by potential patients directly from SVC (“Patient Users“) or for health care providers, by purchasing rights from SVC under the SVC Customer Subscription Agreement for use of the Services by that health care provider’s authorized users (the “Authorized Users“). Collectively, Patient Users and Authorized Users are referred to herein as “Users“. Health care providers who are accessing the Services through an SVC Customer Subscription Agreement are referred to herein as “Customers.” All Users are provided access to the Services pursuant to the SVC User Agreement.

This policy applies to the information we collect:

  • On this Website.
  • In email, text, and other electronic messages between you and this Website.
  • Through our Services, except as set forth below.

It does not apply to information collected by:

  • us offline or through any other means, including on any other website operated by SVC or any third party (including our affiliates and subsidiaries); or
  • any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on the Website
  • Your use of the Services where such use includes providing Protected Health Information (“PHI”), as such term is defined by the Health Insurance Portability and Accountability Act of 1996 and the regulations promulgated thereunder. SVC’s Business Associate Agreement governs the use and disclosure of PHI.

Children Under the Age of 13

Our Website and Services are not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Website and Services. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Information We Collect Through Automatic Data Collection Technologies. As you navigate through and interact with our Website and Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Website and Services, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Website.
  • Information about your device (mobile device, computer, etc…) and an internet connection, including your device’s unique device identifier, IP address, operating system, browser type, mobile network information and the device’s telephone number.

We do not control third parties collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Accessing and Correcting Your Information

You can review and change your personal information by logging in and visiting your account profile page. If you are an Authorized User who was not granted rights to change your personal information by the Customer, please contact the Customer to request such rights or changes to your personal information. 

If you are a Customer, you may also send us an email at [email protected] to request access to, correct or delete any personal information that you or your Authorized Users have provided to us. We may not be able to delete personal information except by also deleting the user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls.
